Terms of Sale

These Terms of Sale are the exclusive and sole terms governing the commercial transaction between Gauntlet Design Studio, dba Angola Sports Center, and the buyer.

• Purchase order numbers, or other invoice related information requested by buyer to appear on documents in no way obligates the seller to any terms or conditions contrary to these Terms of Sale.  We may include these on documentation for buyer convenience only.  Any terms offered contrary to these are unacceptable and rejected in their entirety
• All work has been performed in a professional manner in compliance with all applicable laws, rules and regulations.
• Receipt of goods by retail customers by removal or shipment from our premises constitutes full non-revocable acceptance that goods meet expectations and specifications.  All freight will be prepaid and added.  Title transfers at our dock.
• No warranties, express or implied, are being provided for anything sold.  Buyer agrees it is their responsibility to determine fitness for a given purpose.  We do not guarantee or warrant the fitness of any goods sold for a specific purpose.
• Pick up or delivery dates provided by the buyer are not firm commitments.  They are merely good faith estimates based on current workflow, material, labor and other considerations.  The buyer understands, accepts and agrees that there are conditions outside the seller’s control that may cause delays.  No damages will be paid or discounts provided to buyers for product delivery days beyond our good faith estimate.
• No payment terms are being offered or provided.  Payments must be made before pick up or shipment of products occurs.  Payment terms may be offered to certain non-profits or government agencies at our sole discretion.  Buyer agrees that disputing a credit card charge after receipt of products constitutes theft and fraud subject to prosecution.  Buyer agrees to pay any and all costs associated with collection of overdue accounts.
• Seller may require a deposit, which will be credited in full against balances owed by buyer at time of payment.
• Orders will only be held for a maximum of thirty (30) days for pick up.  After thirty (30) days, the full balance shall be immediately due from the buyer or products purchased and may be disposed of in a manner of sellers choosing with disposal not relieving customer of balance due.
• Refunds may be provided for in store credit only at our sole discretion on stock products that have not been worn, used, had tags removed, or been damaged in any way.  Products that have been customized in any way with special logos, wording, alterations, etc beyond the original product or garment are non-refundable and all sales are final
• Buyer represents and explicitly confirms they have full legal rights to authorize the seller to reproduce any logos, images, wording, trademarks, intellectual property, etc provided to the seller.  Buyer further warrants that they will hold seller harmless and defend (including payment of legal costs, attorney fees and other expenses) seller from any and all claims made by other parties related from any item reproduction provided by Buyer.
• Seller will use due care in working with buyer provided items.  However, buyer agrees to release the seller from any claims resulting in loss or damage of buyer provided items, materials, etc.
